Defense wants to move murder trial out of Chenango

NORWICH – District Attorney Joseph McBride will be traveling to the state capitol Monday to engage defense attorney Randel Scharf in oral arguments regarding a change of venue motion made by the defense in the Peter M. Wlasiuk murder retrial.

“I can not comment on an on going case, but can confirm that the defense filed a change of venue which will be addressed next Monday before the appellate division in Albany,” McBride said Tuesday.



State of New York Supreme Court, Appellate Division, Third Judicial Department, which appealed the murder case nearly two years ago on Aug. 31, 2006, will now have to decide if Wlasiuk can receive a fair trial in Chenango County.

If the motion is approved, the case would be relocated by the court to an area outside of the county. The appellate division may also send the case back to Chenango to see if the county court and the attorneys could select a jury. If the pool of potential jurors was exhausted, then the defense could again renew its motion to move the case.

ok where is this going to end?

it is all about peter getting fair treament.
Well he has already been found guilty of killing his wife, but they turned that over for peter, then he get moved to norwich from attica , he gets it postponed, everytime you read paper he has yet another new attorney which then it has to be fair for this attorney to get caught up on the case so here we go again all for peter , my question is what about the children , patricia's family when do they get fair treatment they lost a family member and have to relive this over and over all so peter get his fair treament.... where is the justice in that ...
this is getting to be crap. have his trial here where it was before and where the crime was commited and if he is truely innocent then he will be set free. lets stop putting everyone else through this hell over and over just so peter can have his proper treament. lets let patricia rest in peace.
