As long as the tax really pays twards the health issues caused by smoking, be it first or second hand, and not to pad other agendas then it is OK. Also the constitutionality of it could be challenged if the ones who voted for it do not truly reflect the poulations choices,on the lines of no taxation without representation. And I havent had a butt since 1981.
