Hate crimes, sex crimes, and drug crimes among August indictments

NORWICH – A Chenango County grand jury met for the month of August and as a result saw 11 individuals indicted last week.

• Wayne J. Spratley, 33, of Greene, was indicted on six felony charges. Spratley was charged with attempted murder in the second degree as a hate crime, a class B felony; assault in the first degree as a hate crime, a class B felony; criminal use of a firearm in the first degree as a hate crime, a class B felony; attempted murder in the second degree, a class B felony; assault in the first degree, a class B felony; criminal use of a firearm in the first degree, a class B felony.



Spratley was said to be employed with the New York State Department of Corrections.

It is alleged that Spratley, on July 19, 2015, in the City of Norwich at approximately 3:28 a.m. in a parking lot on Lackawanna Avenue, did intentionally attempt to cause the death of an African American male by pointing and discharging a Glock Model 20, 10mm handgun into the victim’s left lower abdomen, who then required surgery.

It is also alleged that Spratley did shoot the victim based on his race and did use racial slurs against the victim, which were released – but are not suitable for print.

• John C Bolster Jr., 26, of Hancock, was indicted on two felony charges and one misdemeanor charge. Bolster was charged with the crime of rape in the second degree, a class D felony; criminal sexual act in the second degree, a class D felony; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that Bolster, on a day in the month of July, 2014 on Midland Road in the Town of Afton, that Bolster being over the age of 18-years-old, did engage in sexual intercourse, oral sex, as well as knowingly act in a manor likely to cause injury physically, mentally, or morally to the welfare to the 15-year-old female victim.

• Donald J Mercer, 49, of Columbus, was indicted on four felony charges as well as one misdemeanor charge. Mercer was charged with rape in the third degree, a class E felony; three counts of criminal sexual act in the third degree, a Class E felony; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that on County Road 41 in the Town of Columbus, that Mercer being over the age of 21-years-old, did engage in sexual intercourse in November 2013; oral sex in September 2013; anal sex in December 2013; and oral sex in January 2014; as well in September 2013 knowingly act in a manor likely to cause injury physically, mentally, or morally to the welfare of a child; doing so with a 17-year-old female victim.
