NORWICH – A 26-year-old Norwich man accused of having an ongoing relationship with a 14-year-old girl was released from jail without bail following his appearance in Supreme Court last week.
Judge Kevin M. Dowd ordered the release of Domineco R. Spinella, 26, 66 Borden Ave., from the county jail after he had been placed on $5,000 cash bail by a lower court.
Public Defender Alan E. Gordon told the court Spinella was employed full-time and wished to continue working, had no prior criminal record except for a misdemeanor conviction in 2002, and would live with his parents.
“Your honor, Mr. Spinella has been sitting in jail for the past 27 days and on $5,000 bail. He doesn’t have anywhere near that amount,” said Gordon.
Gordon also said that the relationship between his client and the alleged victim was consensual. “There wasn’t any force involved and no violence indicated the allegations,” said Gordon.
Assistant District Attorney Stephen M. Dunshee said that Spinella’s prior conviction involved “similar predatory circumstances.”
